Terms of Service

These terms are an agreement between you and NATIVE MINDS AI LABS ("we", "us") covering your use of the MemoriesIQ app and website. By using MemoriesIQ you agree to them. If you do not agree, do not use the service.

1. Who can use MemoriesIQ

You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher. If you use MemoriesIQ on behalf of an organisation, you confirm you are authorised to accept these terms for it.

2. Your account

You may start using MemoriesIQ without registering. If you add an email address, you are responsible for keeping access to that mailbox secure — anyone who can receive its one-time codes can reach the memories associated with it.

3. Your content stays yours

You keep all rights to the recordings you make and the transcripts derived from them. You grant us only the limited licence needed to operate the service for you: to store your recordings, transcribe them, index them so they can be searched, and present them back to you.

That licence exists for the purpose of running MemoriesIQ for you and for no other purpose. We do not publish your content, sell it, or use it to train artificial intelligence models.

4. What you may not do

We may suspend or terminate an account that breaches these terms.

5. Automatically generated output

MemoriesIQ uses language models to transcribe your recordings, to summarise them, and to answer questions about them. This output can be wrong, incomplete, or misleading. Do not rely on it for medical, legal, financial, or other consequential decisions. Your original audio is the authoritative record of what you said.

6. Availability, and keeping your own copies

MemoriesIQ is provided on an "as is" and "as available" basis. It is in early access, and we may change, suspend, or discontinue features. We do not promise uninterrupted service.

MemoriesIQ is not a backup service. Although we take care with your data, you should keep your own copies of anything you could not bear to lose.

7. Price

MemoriesIQ is currently free to use. If we introduce paid features we will say so clearly before you are charged, and content you have already recorded will remain accessible to you.

8. Ending it

You can stop using MemoriesIQ at any time and delete your account from within the app, which permanently removes your content as described in the Privacy Policy. We may terminate or suspend access if you breach these terms or if we discontinue the service, and where we discontinue it we will give reasonable notice so you can retrieve your content.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost data or lost profits. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the previous twelve months or US$100.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have consumer rights these terms cannot override.

10. Changes to these terms

We may update these terms. If a change is material we will give notice in the app before it takes effect. Continuing to use MemoriesIQ after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to conflict of law rules, and the courts located in the State of Washington have exclusive jurisdiction, except where mandatory local consumer law gives you the right to bring proceedings where you live.
